Some frequently asked questions:
- What is a Special Purpose Entity (SPE)?
An SPE is a pass-through partnership that exists solely for the purpose of earning Educational Improvement Tax Credits. The Central PA Scholarship Fund (CPSF) is a non-profit that administers various SPEs at no cost to Janus. - Who Qualifies to Participate as a donor?
Any individual or any corporation who pays PA income tax is eligible. There are also options available to individuals who work for non-profits and retirees. CPSF acts as an intermediary, providing individuals and companies who would ordinarily have trouble giving through EITC because of their structure another option to utilize these worthwhile programs. The minimum donation to join the SPE is $3,500. Retirees and non-profit employees can participate as well. - Can non-C corporations participate?
Yes! S Corporations, General Partnerships, Limited Partnerships and Limited Liability Companies (LLC) owners will be participating in the program as individuals with their social security number. The business may write the check in behalf of the owner and claim 100% of the donation as a deduction on the Federal side and the owners will claim 90% credit on the Pennsylvania side. - Why donate through an SPE?
Donors will receive a 90% state tax credit for their donation. So a donation of $10,000 will result in a $9,000 state tax credit for the donor. The Janus School receives 100% of your gift! The 10% delta that cannot be used as a state credit can be used as a charitable donation deduction on the donors federal tax return. - How does it work?
Donors will complete a Joinder Agreement (simple one-page document) which acts as a reservation for the amount of credits you wish to apply for. You will need to estimate your current tax year Pennsylvania liability for your planned donation. The reservations are taken on a first come, first serve basis. The program is highly competitive, so we recommend getting your joinder in by October 31 at the latest in order to have the best chance of securing the credits. Once your credits are secured, you will be asked to write your check. You will receive a PA Department of Revenue form 1123 for the SPE for your PA State Income Tax Return and a Schedule K-1 for your Federal Income Tax Return. You should receive your EITC tax credit after July 1, typically in August, but possibly as late as September.
